Cinergi Pictures Entertainment Inc. was a small independent production company that was founded by Andrew G. Vajna, after he had sold his interest in his first production company, Carolco International Pictures, in 1989. The company had a number of major hit films, most notably Die Hard with a Vengeance in 1995. However, the majority of their films lost money. A string of box office bombs - including Color of Night, Judge Dredd, The Scarlet Letter, Nixon, Shadow Conspiracy, Deep Rising and An Alan Smithee Film: Burn Hollywood Burn - ultimately undid the company, and it closed in 1998.

A director by the name of Alan Smithee has been allowed to direct Trio, a big-budget action film starring Sylvester Stallone, Whoopi Goldberg and Jackie Chan. The studio recuts the film, and when Smithee sees the results (which he describes as being "worse than Showgirls"), he wants to disown the film. However, since his name is also the pseudonym used by Hollywood when someone does not want to have their name attached to a bad film, he steals the film and flees, threatening to destroy the film by burning it.

By the 2080s, much of Earth has become an uninhabitable wasteland. While some humans manage to survive in the wasteland, the majority of humanity resides in huge Mega-Cities with populations of tens of millions, where the traditional justice system has been replaced by a corps of Judges whose role combines those of police officer, judge, jury, and executioner. Mario and Luigi are two Italian American plumbers living in Brooklyn, New York, who are currently being driven out of business by the mafia-like Scapelli Construction Company led by Anthony Scapelli. The trio returns to the flooding where the Mario Bros. manage to fix it but are knocked unconscious by Iggy and Spike, who proceed to capture Daisy.
