The Common Law is a 1931 American Pre-Code romantic drama film, directed by Paul L. Stein and produced by Charles R. Rogers. Based on Robert W. Chambers' 1911 novel, this was the third time the book was made into a film, and the first during the talking film era. The sexual drama stars Constance Bennett and Joel McCrea in the title roles. It was received well both at the box office and by film critics, becoming one of RKO's most financially successful films of the year. The novel, The Common Law, had been filmed before in 1923 with Corinne Griffith starring.

Synopsis

Valerie West is a young American ex-patriot living with her wealthy lover, Dick Carmedon, in Paris. Tired of the relationship, she moves out, after which she meets another American ex-pat, struggling artist John Neville. She begins modeling for Neville, including some racy nude sittings. At first the relationship is purely business, but the two soon fall in love, and she moves in with him. The two begin to live an idyllic life, despite Carmedon's attempts to get Valerie Back.

Doris Kendall (Constance Bennett) is an American nurse working in London during World War I. During an air raid, she meets a young American Aviator, Major Barry Craig, who is enjoying a brief leave from his duties. The two hit it off and fall in love. They plan to marry after the war, but for the moment, they simply enjoy each others' company. After a short while, Craig has to return to the front. It is not long before Doris receives notice that her lover has been shot done behind enemy lines and is presumed dead.

The action takes place in Spain and Puerto Rico during the early 19th-century reign of Ferdinand VII. The Duchess of Arrogan (Irene Rich) is the victim of the machinations of court "climber" Countess Veya (Myrna Loy). The Countess arranges to hide the king's enemy, Duke Cordova (Forrest Stanley) in the Duchess's room where he is discovered resulting in the banishment of both to the colony of Puerto Rico, and the Duchess's estrangement from her powerful husband. In exile the Duchess successfully but cruelly manages her extensive land holdings, nursing bitterness against all men, while Cordova becomes the bandit El Blanco. The two are thrown together and begin an affair. The Duchess's daughter Laska (Florence Fair) arrives, fleeing an unwelcome marriage to which the death of her father has left her vulnerable. Laska is kidnapped and rescued. The Duchess has a happy resolution, reunited with her daughter and Cordova.
