The film is based on the true story of Derek Bentley.
Within the film, Bentley (Eccleston) is an illiterate young adult with developmental disabilities who falls into a gang led by a younger teenager named Chris Craig (Reynolds). The two become trapped by the police, who tell Chris to put down his gun. Bentley says, "Let him have it, Chris." Chris begins firing, killing one officer and wounding another. Because he is a minor (under 18), Chris is given a minor sentence, but Bentley, although he did not shoot anyone, is sentenced to death, on the basis that his statement to Chris was an instigation to begin shooting.

Philadelphia, 1999. In a violent home invasion, engineer Clyde Shelton (Gerard Butler) is forced to witness the rape and murder of his wife and young daughter by Clarence James Darby (Christian Stolte) and his accomplice Rupert Ames (Josh Stewart). Prosecutor Nick Rice (Jamie Foxx) is unable to use DNA evidence to securely convict both accused. Unwilling to take a chance on lowering his high and yet unbeaten 96% conviction rate, he chooses to make a deal with Darby (the actual murderer), letting him plead guilty to a lesser charge, in return for testifying against Ames. Ames is falsely found guilty of masterminding the break-in and both murders and is sentenced to death. Shelton feels betrayed by Rice's actions, as he had pleaded with him not to make the deal and to at least try convict both of them, and because he chose to release the actual killer. A recently promoted police inspector (Gian Maria Volonté) kills his mistress (Florinda Bolkan), and then covers up his involvement in the crime. He insinuates himself into the investigation, planting clues to steer his subordinate officers toward a series of other suspects, including the woman's gay husband and a student radical. In 1927, Roxie Hart sees star Velma Kelly perform ("All That Jazz") at a Chicago theater. Wanting stardom for herself, she begins an affair with Fred Casely, who claims to know the manager. The film focuses on an evidentiary hearing held in Marion County, Florida in February of 2001 which was the site of some but not all of Wuornos' murders for which she was convicted and sentenced to death. It shows the work of the Office of Capital Collateral Regional counsel, led by attorney Joseph T. Hobson who is both interviewed and featured in the film and who seeks to vacate Wuornos' death sentences. It shows Judge Victor Musleh presiding over these proceedings and assistant state attorney, now judge, James McCune who defended the death sentences for the State of Florida. Hobson is shown vigorously cross-examining Wuornos' trial counsel, Steven Glazer, aka "Dr. Legal". Glazer was the unflattering subject of a prior Broomfield documentary on Aileen Wuornos, somewhat the "prequel" to this work, called Aileen Wuornos: The Selling of a Serial Killer.
